Who we are

This Privacy Policy explains how 12khz, LLC, which operates Dust Off Games ("Dust Off Games," "we," "us," or "our"), collects, uses, discloses and protects personal information through our website (the "Site") and our mobile game Dream Team Baseball for iPhone, iPad, and Android phones and tablets (the "Game"). Together, we call these the "Services."

Information we collect

Information you give us

When you sign up on the Site to be notified at launch, we collect your email address. When you email or call us, we collect your name, email address or phone number, and whatever you choose to include in your message.

Information collected automatically on the Site

When you visit the Site, our hosting provider's servers automatically record standard log information: your IP address, browser type and version, operating system, referring URL, the pages you request, and the date and time of your visit. The Site loads its typefaces from Google Fonts, so Google receives your IP address and browser information when a page loads.

We also use Google Analytics on the Site. They use cookies and similar technologies to collect the pages you view, how long you stay, the links you click, your device and browser type, your approximate location based on your IP address, and how you arrived at the Site.

Information in the Game

The Game does not require an account and does not ask for your name, email address, phone number, precise location, contacts or photos. Your teams, rosters, seasons and other progress are stored on your device. The Game plays fully offline.

No analytics. The Game does not include analytics tools and does not send us information about how you play.

Advertising. We may show ads in the Game through an ad network. When the Game requests an ad, the ad network receives only the technical information any app sends to deliver content over the internet, such as your device type, operating system, app version and IP address, so it can send an ad in the right format and count whether it was shown or tapped. The ad network does not use this information to choose which ads you see.

In-app purchases are processed by Apple or Google. They handle your payment details, and we never receive your credit card or bank information. We receive a record that a purchase was made, such as the item purchased and a transaction identifier, so the Game can unlock it.

Information from app stores

Apple and Google provide developers with download counts, sales figures, ratings and, if you have chosen to share them with developers in your device settings, crash reports and usage statistics. These are provided under Apple's and Google's own privacy policies and generally do not identify you.

We do not intentionally collect sensitive personal information, and we ask that you not include it in messages you send us.

How we use information

We use personal information to:

• Send you the launch announcement you signed up for
• Respond to your questions, feedback and support requests
• Deliver and restore in-app purchases
• Operate, secure, maintain and improve the Site and the Game, including fixing crashes
• Understand, in aggregate, how the Site is used
• If the Game includes ads, show contextual ads, limit how often the same ad appears, and count how many ads were shown and tapped
• Comply with legal obligations, enforce our agreements and protect our rights

We do not use automated decision-making that produces legal or similarly significant effects about you.

Cookies, analytics and ads

Analytics on the Site. We use Google Analytics on the Site. It sets cookies and collects the information described in Section 2 on our behalf. We look at analytics in aggregate to see how the Site is used. We have turned off Google Analytics' advertising features, including Google signals and ads personalization, and we do not use analytics to build advertising profiles. The Game does not use analytics.

Google's privacy policy: policies.google.com/privacy. You can opt out of Google Analytics on all websites with Google's browser add-on at tools.google.com/dlpage/gaoptout.

Advertising in the Game. If we add an ad network to the Game, we will update this policy to name it before ads appear. Any ads will be contextual only, meaning they are chosen based on the Game itself and never on information about you, your device or your activity in other apps and websites. We will configure the ad network to treat the Game as directed to children, which turns off personalized advertising and limits what the network may collect.

The Game does not track you across apps and websites owned by other companies, and it does not use your device's advertising identifier.

On the Site. The Site uses analytics cookies. It does not use advertising cookies, retargeting pixels or session recording. Most browsers let you refuse or delete cookies through their settings.

Global Privacy Control. We honor the Global Privacy Control (GPC) and other recognized universal opt-out signals. If your browser or extension sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information from that browser.

How we share information

We disclose personal information to:

• Service providers who perform functions on our behalf, including website hosting, email delivery, analytics and professional advisors. They are contractually limited to using the information to provide services to us.
• An ad network, if we add advertising to the Game, to show and measure contextual ads as described in Section 4.
• Apple and Google, as needed to process, verify and restore in-app purchases through their stores.
• Legal recipients, when required by law, subpoena or court order; to enforce our agreements; or to protect the rights, safety and property of Dust Off Games, our players or others.
• A successor entity in connection with a merger, acquisition, financing or sale of assets.

We do not disclose your personal information to third parties for their own independent marketing purposes.

Sale and sharing of personal information

We do not sell your personal information, and we do not share it for targeted advertising or cross-context behavioral advertising. We do not upload your email address or other contact information to advertising platforms. Our Site analytics and any ads in the Game are set up so that they do not involve selling your information or using it for targeted advertising.

We do not knowingly sell or share the personal information of anyone under 16 years of age.

How long we keep information

We keep your launch signup email address until we send the launch announcement, or until you unsubscribe or ask us to delete it, whichever comes first.

We retain other personal information, such as messages you send us and purchase records, for up to ten (10) years from the date we collect it or from your last interaction with us, whichever is later, after which we delete or de-identify it.

Google Analytics data is kept for 14 months, the setting we have chosen in Google Analytics, and then deleted. Advertising data is retained according to the ad network's settings and defaults, which are generally shorter.

We may retain information longer where necessary to comply with a legal obligation, resolve a dispute or establish or enforce our legal rights. If you ask us to delete your information, we will do so sooner, subject to these exceptions.

Game progress stored on your device stays there until you delete the Game. We do not have a copy of it.

How we protect information

We maintain administrative, technical and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration and destruction. These include encryption in transit, access controls limiting access to what each person's role requires, multi-factor authentication on business systems and vendor security review.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we experience a breach affecting your personal information, we will notify you and any required regulators as the law requires.

Your privacy rights

Depending on where you live, you may have some or all of the following rights:

• Know and access. Confirm whether we process your personal information and get a copy.
• Correct. Have inaccurate personal information corrected.
• Delete. Request deletion of personal information we hold about you.
• Portability. Receive your information in a portable format.
• Opt out. Opt out of targeted advertising, the sale or sharing of personal information and profiling with legal or similarly significant effects.
• Limit. Restrict the use of sensitive personal information.
• Non-discrimination. We will not deny service, charge different prices or provide a different quality of service because you exercised a privacy right.

These rights are available to residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, among others, subject to each state's specific law and exceptions.

How to submit a request. Email team@12khz.com, call 856-701-7947 or write to the address in Section 1. Include enough information for us to locate your records, such as the email address you signed up with, and tell us which right you want to exercise.

Verification. We will ask you to verify your identity before acting, typically by confirming information we already have on file. We do not use verification information for any other purpose.

Authorized agents. You may use an authorized agent to submit a request. We may require written proof of authorization and separate verification of your identity.

Our response. We respond within 45 days. We may extend once by an additional 45 days where reasonably necessary, and will tell you if we do.

Appeals. If we decline your request, you may appeal by emailing team@12khz.com with the subject line "Privacy Appeal" within 30 days. We will respond in writing within 45 days with our decision and the reasons for it. If we deny your appeal, we will provide a method for contacting your state attorney general to submit a complaint.

Emails from us

If you sign up on the Site, we will email you when Dream Team Baseball launches. We will not add you to other mailing lists without asking. Every email includes an unsubscribe link, and we honor unsubscribe requests within 10 business days. You can also opt out at any time by emailing team@12khz.com.

If you contact us, we will still reply to your message after you opt out of marketing emails.

Children's privacy

Dream Team Baseball is rated 4+ and is made for players of all ages, so we treat every player as someone who might be a child. The Game does not ask players for their name, email address or other contact information, and it has no chat or social features.

The Game has no analytics. If the Game shows ads, the ad network receives only the technical information described in Section 2, and only to deliver contextual ads and count them, as the Children's Online Privacy Protection Act (COPPA) permits. Neither we nor the ad network use this information to contact a child, to build a profile of a child, or to show a child ads based on their behavior.

The Site's launch signup is intended for parents and other adults. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has given us personal information, contact team@12khz.com and we will delete it.

We do not sell or share the personal information of consumers under 16.

Where we operate

Dust Off Games is based in the United States. Information we collect is stored and processed in the United States. If you use the Services from outside the United States, you understand that your information will be transferred to and processed in the United States.

Third-party links and app stores

The Site links to third-party websites, including the Apple App Store and Google Play. Your use of those stores, including any purchases, is governed by Apple's and Google's own terms and privacy policies. We are not responsible for the privacy practices of third-party sites. Review their privacy policies before providing information to them.

Changes to this policy

We may update this policy from time to time. When we do, we will revise the "last updated" date above. If we make material changes, we will provide additional notice, such as by posting a notice on the Site or in the Game. Your continued use of the Services after an update means you have read the revised policy.
